You may not submit content — or use the service to transmit any mailpiece — that:
You represent and warrant that, for every postcard you send, you have all rights, consents, and authorizations necessary to mail to each recipient at the address you provide. You are solely responsible for determining that your mailing is lawful and appropriate, including compliance with any opt-out or do-not-mail request. You will not use the service to send mail to any recipient you are not authorized to contact.
You are solely responsible for ensuring that your content, mailing lists, and use of the service comply with all applicable laws, regulations, and industry standards, including postal regulations, consumer-protection laws, advertising and marketing-mail rules, and data-protection laws. We do not review or monitor mailpiece content and make no determination as to its legality or suitability for mailing.
When you provide recipient names, addresses, or any other personal information, you represent and warrant that you have all necessary rights, consents, and authorizations to collect that information and to provide it to us and our fulfillment providers for the purpose of printing and mailing, and that doing so does not violate any third party's privacy, publicity, or other rights.
Current pricing is available on our website. Prices may change from time to time due to changes in postage rates, printing costs, or other factors. We will make reasonable efforts to provide advance notice of significant price increases via email or on-site notification. Price changes will not affect orders already placed or balance already deducted for queued postcards. Your volume pricing tier is based on lifetime top-up amount and does not expire.
Payments are processed through Stripe. You agree to provide accurate payment information and authorize us to charge your payment method.
Account balance is non-refundable and non-transferable. Your balance does not expire but may be subject to account closure policies. Per-card rates are determined by your volume pricing tier at the time each postcard is sent. If pricing changes, the new rates apply to future postcards sent from your balance, not to previously sent postcards.
We aim to deliver postcards within the timeframes specified on our website. Actual delivery times may vary based on destination and circumstances beyond our control.
You are responsible for providing accurate recipient addresses. We are not responsible for delivery failures due to incorrect addresses. Addresses may be processed against the U.S. Postal Service National Change of Address (NCOALink) database and may be updated as a result; we are not responsible for any such changes. Any address verification or deliverability indicator we or our providers offer is informational only and does not guarantee delivery.
While we take care to ensure quality printing and delivery, we cannot guarantee that postcards will not be lost or damaged in transit. We do not provide delivery tracking for postcards, and we have no liability and you are not entitled to a refund or credit if the recipient does not receive a postcard. In such cases, we may offer a reprint or credit at our discretion.
Once a postcard order is submitted and payment is processed, it cannot be cancelled or refunded as printing begins immediately. If you believe there was an error with your order, please contact us within 24 hours.
All content on Postcard.bot, including text, graphics, logos, and software, is owned by us or our licensors and is protected by copyright and other intellectual property laws.
By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content solely for the purpose of providing our services.
Postcards are printed and mailed through third-party fulfillment providers. To fulfill your order, we share recipient addresses and postcard content with these providers, and your use of the service is also subject to their acceptable-use rules. By using the service you agree not to: (a) use the service in any manner those providers prohibit, including the restrictions set out in Section 4; (b) attempt to access, resell, or obtain direct access to any provider's API, systems, or credentials; or (c) reverse engineer, disrupt, or interfere with the service or any underlying provider system. You acknowledge that a complaint or alleged violation reported to a provider may result in suspension of the service as described in Section 11.
Our service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free service.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses. In no event will our total aggregate liability arising out of or relating to the service or these Terms exceed the greater of (a) the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
You agree to indemnify and hold harmless Postcard.bot and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the service; (b) your violation of these Terms; (c) the content of any postcard you submit; (d) recipient or other personal information you provide; (e) your violation of any applicable mailing, consumer-protection, or data-protection law; and (f) any claim passed through to us by a fulfillment provider arising from your use of the service.
We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. We may suspend or terminate your access immediately and without prior notice if we believe you have violated Section 4, if a fulfillment provider reports a complaint or suspected violation relating to your activity, or if a provider suspends or restricts the service. You acknowledge that suspension may be required to resolve a provider complaint and may remain in effect until the complaint is resolved. Upon termination, your right to use the service will immediately cease.
Your use of our service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.
We may modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the service after changes constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
